Ordinance Requiring Face Coverings

 City council meeting coming up this Tuesday evening by GoTo meeting only. you can register here. Major item on the agenda is an ordinance requiring Carbondale owners to make sure their employees wear face masks by providing for employer liability if they do not.

Adopt and ordinance requiring employers to ensure employees wear face coverings.

Background:

 

Since Ordinance 2020-24 was adopted, City staff has responded to multiple complaints concerning employees of businesses not wearing face coverings. As a result, the staff has reviewed the possibility, and the legality, of establishing employer liability for employees failing to wear face coverings. It's the City Attorney's opinion that employers are better suited to control the behavior of their employees. By providing for employer liability, the City can more easily enforce the current mask ordinance and ensure the safety of employees and customers. 

 

Additionally, Staff has been working with the Jackson County Health Department (JCHD) to seek compliance of one local business where at least 10 positive cases of COVID have been traced to. Following conversations with JCHD, it's our belief that placing responsibility on the employer to require face coverings of their employees will provide an additional, and more effective tool to facilitate compliance of businesses.

 

Recommended Action: It's recommended that the City Council adopt and ordinance requiring employers to ensure employees wear face coverings.
